Terms of Service — Real or Fake Moldavite?

Effective date: August 1, 2026

These Terms of Service (“Terms”) govern your use of the website realorfake.naturalmoldavites.com and the moldavite authenticity assessment service offered on it (the “Service”). By submitting a request or using the website, you agree to these Terms.

1. Who we are

The Service is operated by CZleaf LLC, 30 N Gould St Ste 6952, Sheridan, WY 82801, United States (“we”, “us”). We also operate the moldavite e-shop naturalmoldavites.com. You can contact us at realorfake@naturalmoldavites.com.

2. What the Service is — and what it is not

The Service lets you submit photographs of a moldavite you own, or a link (URL) to a moldavite offered for sale online, and receive our assessment of whether the stone appears to be a genuine moldavite or a fake.

Please understand the nature of this assessment:

  • It is an informed opinion based on our long-term experience with moldavites, formed from the photographs, measurements, and other information you provide.
  • It is not a certified gemological examination, laboratory analysis, or official appraisal, and it does not produce a certificate of authenticity.
  • We never physically examine the stone. An assessment from photographs or a listing URL has inherent limits.

The basic assessment is free of charge. You may optionally pay for priority processing (see Section 4).

3. How it works

  1. You submit a request through the website — either with 1 to 5 photographs of your stone (plus approximate dimensions, weight, and optional details), or with the URL of an online listing.
  2. You provide your e-mail address. We send all updates, including the result, to that address, together with a private link to your request.
  3. We review requests in order (see Section 4) and record the result on your request page and by e-mail.

You must provide a valid e-mail address and truthful information. Requests with unusable materials (e.g. blurry photos, dead links) may be closed as “unable to determine” or we may ask you for better materials.

4. Free vs. priority processing; payment

  • Free processing: we normally respond within 1–2 weeks. This is a typical time, not a guaranteed deadline; during busy periods it may take longer.
  • Priority processing: for a one-time fee of USD 5.90 we normally respond within 1–2 business days. Priority requests are processed before free requests — that is what the fee pays for: a place at the front of the queue and our commitment to treat your request as urgent.
  • Payment is processed by Stripe on a secure hosted payment page. We do not see or store your card number.
  • If you choose priority but the payment is not completed, your request remains in the system and is processed as a free request. You can upgrade any pending free request to priority at any time before it is resolved, using the link on your request page.
  • Note for consumers in the EU/UK: by paying for priority processing you expressly request that we begin performing the service immediately, and you acknowledge that once the service has been fully performed (your assessment delivered), you lose the statutory right to withdraw from the contract. If you withdraw before we deliver the assessment, we will refund the fee.

5. No guaranteed result

Determining authenticity from photographs or an online listing is not an exact science. We do not guarantee the accuracy, completeness, or usefulness of any assessment. The result is our honest professional opinion, but it can be wrong — sophisticated fakes exist, and photographs can hide or distort important features. You should treat the assessment as one input into your own decision, not as a definitive fact.

6. Inconclusive results and refunds

Sometimes the materials provided simply do not allow us to reach a conclusion either way. In that case we will close your request with the result “unable to determine” and, where possible, explain what prevented a conclusion.

If you paid for priority processing and the result is “unable to determine”, we will refund the full priority fee of USD 5.90. The refund is initiated by us through Stripe to your original payment method, normally within 5 business days of resolving the request; depending on your bank, the money typically arrives within 5–10 business days after that. You do not need to ask for this refund — it is automatic.

The fee is not refunded merely because you disagree with the assessment, or because the result is “likely fake”.

Priority guarantee: if we do not deliver your priority result within 5 business days of your payment, we will automatically refund the full priority fee — you do not need to ask — and we will still complete your assessment as a priority.

7. Your content and your responsibilities

By uploading photographs or other materials, you confirm that:

  • you own the rights to them or have permission to use them for this purpose;
  • they do not contain unlawful content, content infringing anyone’s rights, malware, or content unrelated to the purpose of the Service;
  • when submitting a listing URL, you are doing so to assess a stone, not to harass or defame the seller.

You grant us a non-exclusive license to store, process, and review the submitted materials for the purpose of providing the Service. We will not publish your photographs or use them for marketing without your separate consent.

8. Our rights

We may, at our discretion:

  • refuse or close a request — for example if the materials are unusable, the request is abusive, automated, duplicated, or unrelated to moldavite authenticity (any priority fee paid for a refused request will be refunded);
  • remove content that violates Section 7;
  • limit the number of requests per person where we suspect abuse;
  • modify, suspend, or discontinue the Service. Pending paid priority requests will either be completed or refunded.

9. Disclaimer and limitation of liability

The Service is provided “as is”. To the maximum extent permitted by law:

  • we are not liable for any decision you make based on an assessment — including buying, not buying, selling, returning, or claiming a refund for a stone from any third party;
  • our total liability arising from the Service is limited to the amount you actually paid us for the request concerned (i.e. at most USD 5.90, or zero for free requests);
  • we are not liable for indirect or consequential damages, or for the acts of third-party sellers whose listings you ask us to assess.

Nothing in these Terms excludes liability that cannot be excluded by applicable law, including mandatory consumer protections in your country of residence.

10. Privacy

How we handle your personal data is described in the Privacy Policy below, which forms part of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. The current version, with its effective date, is always published on this page. Changes apply to requests submitted after the change takes effect; requests already submitted are governed by the version you agreed to.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. If you are a consumer in the European Union or the United Kingdom, you also enjoy the protection of the mandatory provisions of the law of your country of residence, and nothing in this Section deprives you of that protection. We will always try to resolve any dispute informally first — please write to us at realorfake@naturalmoldavites.com.

This policy explains what personal data we collect on realorfake.naturalmoldavites.com, why, and what your rights are. The data controller is CZleaf LLC, 30 N Gould St Ste 6952, Sheridan, WY 82801, United States, e-mail realorfake@naturalmoldavites.com.

1. What data we collect

  • E-mail address — required for every request and for the “My requests” login link.
  • Request content — photographs of your stone, dimensions, weight, where and for how much you bought it (optional), your note, or the listing URL you want assessed. Photographs are re-encoded on upload and embedded metadata (EXIF, including GPS location) is removed.
  • Payment metadata — if you pay for priority: payment status, amount, currency, time, and Stripe’s payment identifier. We never receive or store your card number; card details go directly to Stripe.
  • Technical data — IP address and basic request logs (time, page), kept for security and abuse prevention.
  • Usage statistics — how visitors use the public pages of the site (pages viewed, approximate location, device and browser type), collected via Google Analytics (see Sections 3 and 5).
  • Correspondence — messages you send via the contact form or e-mail.

We do not collect more than we need, and we never ask for data unrelated to the Service.

2. Why we process it (purposes and legal bases)

  • Providing the Service — receiving, assessing, and answering your request; sending you the result and login links (performance of a contract, GDPR Art. 6(1)(b) for EU users).
  • Payments and refunds — processing the priority fee via Stripe (performance of a contract; legal obligations for accounting records).
  • Security and abuse prevention — rate limiting, spam and fraud detection using IP and logs (legitimate interest, Art. 6(1)(f)).
  • Understanding how the Service is used — aggregate usage statistics for the public pages of the site, collected via Google Analytics (legitimate interest, Art. 6(1)(f); see Section 5 for the cookies involved).
  • Responding to your messages sent via the contact form.

We do not use your data for marketing and we do not send newsletters. If we ever want to contact you for any other purpose, we will ask for your consent first. We do not sell personal data.

3. Who has access to your data

We share data only with service providers who need it to run the Service:

  • Stripe, Inc. — payment processing (they receive your e-mail and payment details you enter on their page; Stripe participates in the EU-U.S. Data Privacy Framework — see Stripe’s own privacy policy).
  • Our web hosting provider — the website, database, and uploaded photos are stored on its servers.
  • E-mail delivery — transactional e-mails (confirmations, results, login links) are sent from our hosting infrastructure or via our e-mail delivery provider Brevo (Sendinblue SAS, France), which receives your e-mail address and the message content.
  • Google LLC — website analytics (Google Analytics; receives usage data described in Section 1 from the public pages of the site; Google participates in the EU-U.S. Data Privacy Framework — see Google’s own privacy policy).

We may also disclose data where required by law. No other third parties receive your data.

4. How long we keep it

  • Requests (photos, details, result, your e-mail) — 12 months after the request is resolved, then deleted.
  • Payment and accounting records — as long as tax and accounting laws require (typically up to 10 years); these records contain payment metadata, not your photographs.
  • Security logs (IP addresses) — up to 6 months.
  • Contact-form correspondence — up to 12 months after the conversation ends.

If you ask us to delete your data earlier, we will (see Section 6), except data we must keep by law.

5. Cookies

Strictly necessary cookies: a single session cookie that keeps you signed in to “My requests” after you use an e-mail login link (kept for up to 30 days), and a short-lived technical cookie for form security.

Analytics cookies: on the public pages of the site we use Google Analytics 4, which sets its own cookies (_ga, _ga_*, kept for up to 2 years) to help us understand how the site is used. Private pages — your request page, login links, and “My requests” — are not measured. You can block or delete these cookies in your browser settings, or install Google’s opt-out add-on; the Service works fully without them. We use no advertising cookies.

6. Your rights

You can at any time e-mail realorfake@naturalmoldavites.com to:

  • access the data we hold about you (we will send you a copy);
  • correct inaccurate data;
  • delete your data (“right to be forgotten”) — we will delete your requests, photos, and e-mail, except records we must keep by law;
  • object to processing based on legitimate interest;
  • receive your data in a portable format.

We will respond within 30 days. To protect your data, we may need to verify that the request comes from the e-mail address associated with the data. EU/UK users also have the right to lodge a complaint with their local data protection authority.

7. International data transfers

CZleaf LLC is a United States company and your data is processed in the United States (and on the servers of our hosting provider). If you are in the EU/UK, this means your data is transferred outside the EEA. We handle all data in line with this policy regardless of where you live, and we apply appropriate safeguards for such transfers (standard contractual clauses with our processors where applicable).

8. Security

The website runs over HTTPS, uploaded photos are stored outside the public web root and served only through authenticated links, request pages are protected by long random tokens, and access to the admin interface is restricted. No system is perfectly secure, but we take reasonable technical and organizational measures to protect your data.

9. Children

The Service is not directed at children under 16, and we do not knowingly collect their data. If you believe a child has submitted data to us, contact us and we will delete it.

10. Changes to this policy

We may update this policy; the current version with its effective date is always on this page. For significant changes we will notify users with pending requests by e-mail.
